Notas del Capítulo 29 (clasificación)
一、 Salvo disposición en contrario, las partidas de este capítulo comprenden únicamente:
(一) Los compuestos orgánicos de composición química definida, presentados aisladamente, aunque contengan impurezas;
(二) Las mezclas de dos o más isómeros de un mismo compuesto orgánico (aunque contengan impurezas), excepto las mezclas de isómeros de hidrocarburos acíclicos (distintas de los estereoisómeros), saturadas o no, que se clasifican en el capítulo 27;
(三) Los productos de las partidas 29.36 a 29.39, los éteres de azúcares, acetales de azúcares, ésteres de azúcares y sus sales de la partida 29.40, y los productos de la partida 29.41, incluso sin composición química definida;
(四) Las soluciones acuosas de los productos de los apartados (一), (二) y (三);
(五) Los productos de los apartados (一), (二) y (三) disueltos en otros disolventes, siempre que dicha solución constituya un modo de presentación normal e indispensable adoptado exclusivamente por razones de seguridad o para el transporte, y que el disolvente no haga al producto apto para usos específicos distintos de su uso general;
(六) Los productos de los apartados (一), (二), (三), (四) y (五) con adición de un estabilizante (incluidos los agentes antiaglomerantes) necesario para su conservación o transporte;
(七) Los productos de los apartados (一), (二), (三), (四), (五) y (六) con adición de un agente antipolvo, un colorante, un aromatizante o un emético para facilitar su identificación o por razones de seguridad, siempre que dicha adición no haga al producto apto para usos específicos distintos de su uso general;
(八) Los productos siguientes, diluidos hasta concentración normal para la obtención de colorantes azo: sales de diazonio, agentes de copulación utilizados con sales de diazonio, aminas diazotables y sus sales.
二、 Este capítulo no comprende:
(一) Las mercancías de la partida 15.04 ni el glicerol en bruto de la partida 15.20;
(二) El alcohol etílico (partidas 22.07 o 22.08);
(三) El metano y el propano (partida 27.11);
(四) Los compuestos del carbono mencionados en la nota 2 del capítulo 28;
(五) Los inmunológicos de la partida 30.02;
(六) La urea (partida 31.02 o 31.05);
(七) Las materias colorantes de origen vegetal o animal (partida 32.03), las materias colorantes orgánicas sintéticas, los productos orgánicos sintéticos de los tipos utilizados como agentes de blanqueo fluorescente o como luminóforos (partida 32.04) y los tintes u otras materias colorantes en envases para la venta al por menor (partida 32.12);
(八) Las enzimas (partida 35.07);
(九) El metacetaldehído, la hexametilentetramina (metenamina) y productos similares presentados en pastillas, barritas o formas análogas para ser utilizados como combustible, y los combustibles líquidos o gases licuados en recipientes de capacidad inferior o igual a 300 cm³ utilizados para cargar mecheros de cigarrillos y encendedores análogos (partida 36.06);
(十) Los preparados extintores cargados y las granadas y bombas extintoras cargadas (partida 38.13); los quitamanchas de tinta en envases para la venta al por menor (partida 38.24); o
(十一) Los elementos de óptica, por ejemplo, los fabricados con etilendiamina tartrato (partida 90.01).
三、 Las mercancías clasificables en dos o más partidas de este capítulo se clasifican en la última de dichas partidas.
四、 Los derivados halogenados, sulfonados, nitrados o nitrosados de las partidas 29.04 a 29.06, 29.08 a 29.11 y 29.13 a 29.20 comprenden los derivados mixtos (por ejemplo, los derivados halosulfonados, halonitrados, sulfonitrados y halosulfonitrados).
Los grupos nitro y nitroso no se consideran funciones nitrogenadas a efectos de la partida 29.29.
A efectos de las partidas 29.11, 29.12, 29.14, 29.18 y 29.22, la expresión «funciones oxigenadas» solo comprende las funciones de las partidas 29.05 a 29.20 (caracterizadas por funciones oxigenadas orgánicas).
五、
(一) Los ésteres de compuestos orgánicos con función ácida del subcapítulo I al VII con compuestos orgánicos de dichos subcapítulos, se clasifican en la última partida que corresponda a uno u otro tipo de compuesto.
(二) Los ésteres del alcohol etílico con compuestos orgánicos con función ácida del subcapítulo I al VII se clasifican en la partida del compuesto con función ácida.
(三) Salvo lo dispuesto en la nota 1 de la sección VI y en la nota 2 del capítulo 28:
1. Las sales inorgánicas de compuestos orgánicos comprendidos en los subcapítulos I al X y en la partida 29.42, tales como los compuestos con función ácida, fenólica o enólica y las sales inorgánicas de bases orgánicas, se clasifican en la partida del compuesto orgánico correspondiente;
2. Las sales formadas entre compuestos orgánicos del subcapítulo I al X y de la partida 29.42, se clasifican en la última partida de este capítulo que corresponda a la base o al ácido (incluidos los compuestos con función fenólica o enólica) que les haya dado origen;
3. Los compuestos de coordinación, excepto los de los subcapítulos XI o la partida 29.41, se clasifican en la última partida del capítulo 29 que corresponda a los fragmentos resultantes de «romper» todos los enlaces metal-ligando del compuesto (excepto los enlaces metal-carbono).
(四) Los alquilatos metálicos (excluido el etilato) se clasifican en la partida del alcohol correspondiente (partida 29.05).
(五) Los haluros de acilo de ácidos carboxílicos se clasifican en la partida del ácido correspondiente.
六、 Los compuestos de las partidas 29.30 y 29.31 son compuestos orgánicos cuyas moléculas contienen, además de átomos de hidrógeno, oxígeno o nitrógeno, átomos de otros no metales o de metales (por ejemplo, azufre, arsénico o plomo) directamente enlazados a átomos de carbono.
Las partidas 29.30 (compuestos organo-sulfurados) y 29.31 (demás compuestos organo-inorgánicos) no comprenden ciertos derivados sulfonados o halogenados (incluidos los mixtos) cuyas moléculas solo contienen, además de hidrógeno, oxígeno y nitrógeno, átomos de azufre o de halógeno directamente enlazados a átomos de carbono con función de derivados sulfonados o halogenados (o mixtos).
七、 Las partidas 29.32, 29.33 y 29.34 no comprenden los epóxidos con anillo de tres átomos, los perácidos cetónicos, los polímeros cíclicos de aldehídos o tioaldehídos, los anhídridos de ácidos policarboxílicos, los poliésteres cíclicos de polialcoholes o polifenoles con poliácidos, ni las poliimidas de poliácidos.
Esta disposición solo es aplicable cuando el heterátomo en el anillo proviene de la función ciclizante enumerada en la presente nota.
八、 A efectos de la partida 29.37:
(一) El término «hormonas» comprende los factores liberadores de hormonas, los factores estimulantes y liberadores de hormonas, los inhibidores de hormonas y los anticuerpos contra hormonas;
(二) La expresión «que actúen principalmente como hormonas» se aplica no solo a los derivados hormonales y análogos estructurales con acción hormonal principal, sino también a los derivados hormonales y análogos estructurales utilizados principalmente como intermedios en la síntesis de los productos de esta partida.
Notas de subpartida:
一、 Los derivados de un compuesto (o grupo de compuestos) clasificable en una partida de este capítulo, si no están incluidos de forma expresa en ninguna otra subpartida de esa partida y no existe subpartida residual «Los demás», se clasifican en la misma subpartida que dicho compuesto (o grupo de compuestos).
二、 La nota 3 del capítulo 29 no es aplicable a las subpartidas de este capítulo.
El término «ácido tereftálico puro» de la subpartida nacional 2917.3611 designa cristales aciculares o un polvo blanco con una densidad de aproximadamente 1,510 g/cm³ que sublima a unos 300 °C. El producto es soluble en soluciones alcalinas, ligeramente soluble en etanol caliente e insoluble en éter etílico, ácido acético glacial y cloroformo; se utiliza en la fabricación de resinas sintéticas, fibras sintéticas y plastificantes, entre otros. Su principal indicador técnico es: 4-carboxibenzaldehído (4-CBA) ≤ 25 ppm.
